SADNI CAR
Rental Terms and Conditions
These terms govern the rental of a SADNI CAR vehicle. SADNI CAR operates on a booking request model: availability and finalisation of the rental agreement are confirmed manually by our team.
Article 1 — The parties to the contract
First party: the self-drive car rental company, identifiable on the first page.
Second party: the RENTER, declared and identifiable on page 1 of this contract, referred to as "the RENTER".
Article 2 — Condition of the vehicle
The five tyres are in good condition. Should any of them be damaged for a reason other than normal wear, or should any of them disappear, the customer undertakes to replace it immediately with a tyre of the same size, of the same brand and with an equivalent level of wear.
Article 3 — Fuel and oil
Fuel is at the RENTER's expense.
The RENTER must regularly check the oil and water levels every 1,000 km.
Any breakdown caused by a lack of verification will be charged to the RENTER.
Article 4 — Maintenance and repairs
Normal mechanical wear is at the expense of the COMPANY.
All repairs resulting from an accidental cause or from breakdowns will be at the expense of the RENTER.
Article 5 — Use of the vehicle
The rental is personal and is in no case transferable.
The RENTER undertakes not to let the vehicle be driven by any person other than those listed in the contract.
Article 6 — Insurance and accidents
The RENTER is insured under the general conditions of the insurance policies contracted by the COMPANY, which the RENTER declares to know well:
- A. Accidents caused to third parties, without limitation.
- B. Insurance of the vehicle against theft, fire and civil liability. Accessories, clothing and any item forgotten inside the vehicle or in the trunk are not covered.
- C. Damage caused to the vehicle as well as theft or fire will be entirely at the expense of the RENTER, in addition to daily indemnities estimated at the applicable rental rate, from the date of the breakdown until the vehicle is returned to service.
- D. The RENTER must notify the COMPANY, as soon as possible, of any accident, theft or fire. The declaration must state the exact circumstances, in particular the place, date, time and witnesses, with a supporting report.
- E. If a defect is observed in the condition of the rented vehicle, the RENTER must inform the COMPANY within three hours after signing the contract. Failing that, the RENTER remains liable for any breakdown.
Article 7 — Payment, deposit, prepayment and extension
The rental and prepayment amounts are determined by the applicable rates and are payable in advance.
The deposit may in no case be used if the RENTER wishes to keep the vehicle for a longer period than that indicated in the contract.
The COMPANY accepts payment by cheque for the settlement of rented days or for damage caused to the vehicle.
The RENTER declares to know well that any cheque handed over constitutes a payment.
Article 8 — Damages and indemnities
The RENTER undertakes to repair the damage caused to the vehicle and to pay all daily indemnities, by settling an amount initially agreed on at rental, in cash or by cheque.
In the case of payment by cheque, the RENTER remains liable and is exposed to legal proceedings in the event of absence or insufficiency of funds, or non-conformity of signature.
The RENTER acknowledges the sincerity and validity of the substance and form of any cheque issued, and may in no case bring proceedings against the COMPANY.
Article 9 — Vehicle documents
The RENTER must return to the COMPANY, upon returning the vehicle, all documents relating to its circulation.
Failing that, the rental will continue to be billed at the initial rate until the said documents are returned.
Article 10 — Liabilities
The RENTER alone remains liable for the fines, contraventions, official reports and customs proceedings issued against them.
Article 11 — Jurisdiction
In the event of a dispute, only the court of Morocco has jurisdiction.
All legal costs are at the expense of the RENTER.
Article 12 — Additional mileage
In the event that the threshold of 200 km per day is exceeded, each additional kilometre will be billed at 2 MAD per kilometre.
